Description
Description (Service) | The Federal Child Support Guidelines are regulations under the federal Divorce Act. They set out rules and tables to calculate how much child support should be paid if you divorce or are already divorced. Provincial or territorial child support laws and guidelines apply in all other situations. The Federal Child Support Guidelines came into force in 1997. The tables in the Guidelines were updated in May 2006 and again in December 2011. If you have a child support order made before the tables were updated, and if applying the updated tables would result in a different child support amount, you have a right to renegotiate child support payments or ask the court for a new child support order. The Federal Child Support Guidelines: Step-by-Step guide can help you calculate what the amount of child support would be if you use the Federal Child Support Guidelines and the updated tables. The Guidelines set out the amount the parent paying child support should pay. The amount is based on the paying parent's income, the number of children being supported, and the province or territory where the paying parent lives. Special circumstances can be applied to alter the amount (e.g. undue hardship, special expenses). To find statutes, regulations, recent legislation, court decisions, constitutional documents and related materials, refer to the Guide to Canadian Legal Information at: http://www.justice.gc.ca/eng/contact/comm2.html * if you are unable to access what you need on the Web site, call or email for more information |
